Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of https://pigeonaerospace.us and any webpage that links to these Terms (collectively, the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not access or use the Site.
If you use the Site on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms, and "you" includes that organization.
2. Purpose of the Site; No Offer or Reliance
The Site is an informational resource describing Pigeon Aero's platform, capabilities, and potential commercial and government applications. The Site does not offer products or services for direct purchase and does not distribute controlled technical data, engineering drawings, or export-controlled information.
Site content, including platform descriptions, specifications, performance statements, availability, range, takeoff/landing performance, payload figures, and development plans, is provided for general informational purposes, reflects an in-development platform, and is subject to change without notice. Nothing on the Site constitutes a binding offer, quotation, representation, warranty, commitment to supply, or guarantee of performance. No contract is formed by accessing the Site or submitting a Contact-form inquiry. You are responsible for independently evaluating Site information before relying on it.
3. Permitted Use; Contact Form
You may use the Site only for lawful, internal business-information purposes and in accordance with these Terms. The Contact form is intended for legitimate business inquiries, including those from government personnel, defense contractors, authorized program managers, potential commercial counterparties, and other prospective business contacts.
You will not, and will not permit any third party to: submit inaccurate, misleading, unlawful, harmful, defamatory, infringing, or unauthorized material; submit classified information, ITAR-controlled technical data, EAR-controlled technical data, proprietary information you are not authorized to disclose, malware, or other restricted information through the Site; use the Site for spam, unsolicited advertising, phishing, or any unlawful purpose; interfere with, disrupt, probe, scan, test the vulnerability of, or circumvent the security or access controls of the Site; use automated means to access, scrape, index, harvest, or extract Site content except as permitted by standard search-engine protocols or with Pigeon Aero's prior written consent; or infringe, misappropriate, or violate Pigeon Aero's or any third party's intellectual-property, privacy, publicity, or other rights.
Pigeon Aero may suspend or block access to the Site, or decline to respond to an inquiry, if it reasonably believes a violation of these Terms has occurred.
4. Intellectual Property; Limited License; Feedback
The Site and all content made available through it, including text, graphics, photographs, designs, renderings, logos, marks, product names, software, and the selection and arrangement of those materials (collectively, "Site Content"), are owned by Pigeon Aero or its licensors and are protected by intellectual-property and other laws. Pigeon Aero and Pigeon Aerospace names, logos, and marks are Pigeon Aero's trademarks or trade names and may not be used without prior written permission.
Subject to these Terms, Pigeon Aero grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and display the Site Content solely for your lawful, internal business-information use. Except for this limited license, no right, title, or interest in the Site or Site Content is granted or transferred to you. You may not copy, reproduce, modify, create derivative works from, publicly display, publicly perform, distribute, publish, sell, license, reverse engineer, or otherwise exploit any Site Content without Pigeon Aero's prior written consent, except to the extent such restriction is prohibited by applicable law.
If you provide suggestions, comments, or feedback about the Site or Pigeon Aero's products or services, you grant Pigeon Aero a perpetual, irrevocable, worldwide, royalty-free right to use and exploit that feedback without restriction or compensation, provided that Pigeon Aero will not identify you as the source without your permission.
5. Export Controls
Pigeon Aero's technology may be subject to ITAR, EAR, and other U.S. export-control laws. You must comply with all applicable export-control, sanctions, and import laws in connection with your use of the Site and any resulting communications. You may not access, use, export, re-export, transfer, or provide access to any Site Content or information obtained from the Site in violation of those laws. The Site does not knowingly provide controlled technical data to unauthorized recipients.
6. Third-Party Links
The Site may contain links to third-party websites or resources. Those links are provided for convenience only. Pigeon Aero does not control, endorse, sponsor, or assume responsibility for third-party content, products, services, availability, security, or privacy practices. Your use of a third-party site is at your own risk and subject to its terms and privacy policy.
7. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND SITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." PIGEON AERO AND ITS LICENSORS, SUPPLIERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE PRACTICE. PIGEON AERO DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT SITE CONTENT WILL BE CURRENT, COMPLETE, OR ACCURATE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIGEON AERO AND ITS LICENSORS, SUPPLIERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SITE, SITE CONTENT, OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIGEON AERO'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE, SITE CONTENT, OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
The limitations in this Section apply even if a remedy fails of its essential purpose. Some jurisdictions do not permit certain limitations of liability; in those jurisdictions, the foregoing limitations apply only to the extent permitted by law.
9. Indemnification
To the maximum extent permitted by applicable law, you will defend, indemnify, and hold harmless Pigeon Aero and its licensors, suppliers, officers, directors, employees, agents, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Site in violation of these Terms; (b) information or material you submit through the Site; or (c) your violation of applicable law or a third party's rights. Pigeon Aero may assume the exclusive defense and control of any matter subject to indemnification, and you will reasonably cooperate with that defense.
10. Governing Law and Venue
These Terms and any dispute arising out of or relating to them, the Site, or Site Content are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. You and Pigeon Aero consent to the exclusive jurisdiction and venue of the state and federal courts located in Pima County, Arizona, except that either party may seek equitable relief in any court of competent jurisdiction to protect its intellectual-property or confidential-information rights.
11. Changes to These Terms
Pigeon Aero may update these Terms from time to time by posting the revised Terms on the Site and updating the Effective Date. To the extent permitted by law, your continued use of the Site after the revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree to revised Terms, you must stop using the Site.
12. General
These Terms, together with any terms expressly incorporated by reference, are the entire agreement between you and Pigeon Aero concerning the Site and supersede prior or contemporaneous understandings concerning the Site. If any provision is held unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Pigeon Aero's failure to enforce any provision is not a waiver. You may not assign or transfer these Terms without Pigeon Aero's prior written consent; Pigeon Aero may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets. Sections that by their nature should survive will survive termination of these Terms.
